These Terms and Conditions ("Terms") govern your access to and use of the services offered by Flapico Technologies Private Limited ("Flapico", "we", "us", or "our") through our Prompt Testing and Evaluation Platform (the "Platform").
By using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Use of the Platform
a. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to use the Platform. By using the Platform, you represent and warrant that you meet this requirement.
b. Account Registration
To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your credentials and all activities under your account.
c. Permitted Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You may not:
Reverse-engineer, copy, or resell the Platform
Use the Platform for any activity that violates applicable laws or third-party rights
Attempt unauthorized access to any part of the Platform or its systems
2. LLM API Credentials
When you connect external LLM providers (e.g., OpenAI, Azure), you may provide API credentials. These credentials are:
Encrypted using Fernet symmetric encryption
Used solely to connect and interact with LLMs on your behalf
Never shared or stored in plaintext
You are responsible for ensuring you have the right to use any API services you connect.
3. Intellectual Property
All intellectual property related to the Platform—including but not limited to software, design, trademarks, and content—is owned by or licensed to Flapico. You are granted a limited, non-exclusive, non-transferable license to use the Platform for your internal business or personal use.
4. User Content
You retain ownership of the prompts, responses, and metadata you submit ("User Content"). By submitting content, you grant Flapico a non-exclusive, royalty-free license to process and store it solely for the purpose of providing and improving the Platform.
You must ensure that your User Content:
Does not infringe on intellectual property rights
Is not unlawful, offensive, or harmful
5. Fees and Billing
Some features of the Platform may be offered under paid plans. By subscribing to a paid plan, you agree to the applicable pricing and billing terms provided at the time of purchase.
Flapico reserves the right to change pricing with prior notice.
6. Termination
We reserve the right to suspend or terminate your account and access to the Platform at our discretion, especially in cases of violation of these Terms or applicable laws.
You may terminate your use at any time by deleting your account.
7. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:
The Platform will be error-free or uninterrupted
Results generated via third-party LLMs will be accurate or reliable
You use the Platform at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, Flapico shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Platform.
Our total liability to you shall not exceed the amount paid by you (if any) for the service in the twelve (12) months prior to the claim.
9. Third-Party Services
The Platform may interface with third-party APIs (e.g., OpenAI, Azure). You are solely responsible for complying with the terms of those third-party services. Flapico is not liable for the actions or data handling of third-party providers.
10. Privacy
Please refer to our Privacy Policy to understand how we collect, use, and protect your information.
11. Modifications to the Terms
We may update these Terms from time to time. Continued use of the Platform after changes means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of the Republic of India, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in [Your City/State].
